MANILA, Philippines — If Sen. Ronald “Bato” Dela Rosa were to be asked, there is no longer a need for senators to debate whether or not they should abide by the Supreme Court’s (SC) decision against proceeding with the impeachment trial of Vice President Sara Duterte.
The Senate is expected to vote on the SC ruling on Wednesday.
“Why debate it when the Supreme Court has already spoken? The Supreme Court has made its decision, so why should we still argue about it?” Dela Rosa told reporters on Tuesday.

“I’m not a lawyer, as I’ve said, but I believe that nobody is supreme or above the Supreme Court—except God,” he added.
The SC, in a unanimous decision last week, declared the case against Duterte unconstitutional for violating the one-year ban on filing impeachment cases.
While all branches of government are equal, dela Rosa also pointed out that only the Supreme Court is mandated by the Constitution to interpret all legal and constitutional questions.

The senator stressed it was only his personal decision and that he would respect the request of Senate President Francis “Chiz” Escudero to allow the debate and hear the arguments of those who are supporting or opposing the SC ruling.
As far as he is concerned, however, dela Rosa said the case against Duterte is already closed.

The House of Representatives has already asked the high tribunal to reconsider its decision, urging it to allow Congress to perform its constitutional duty of trying and deciding on impeachment cases.
Duterte was impeached by 215 House members on February 05, which prompted the convening of the Senate as an impeachment court.

At the start of the trial on June 10, dela Rosa immediately moved for the dismissal of the impeachment case against Duterte. But his motion was amended by Sen. Alan Peter Cayetano, who instead sought to remand the case to the House.
This time, dela Rosa said he would listen first to the arguments on the floor although he said he is inclined to obey the ruling of the court.
“As I’ve said, I’m not overeager to move for dismissal,” the senator maintained. /apl
